
Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Partyfiy website, mobile application, and related services (collectively, the “Service”) operated by Partyfiy Inc. (“Partyfiy,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility & accounts
You must be at least 18 years old and legally able to enter contracts to use the Service. You agree to provide accurate, current information when registering, to keep your credentials secure, and to be responsible for all activity under your account. You may not transfer or sell your account.
2. Two-sided marketplace
Partyfiy is a two-sided marketplace connecting customers planning events with vendors offering services and rentals. Partyfiy facilitates discovery, communication, booking, and payments but is not a party to the contract for services between a customer and a vendor. The vendor is solely responsible for performing the agreed services, and the customer is responsible for paying the agreed amounts.
3. Bookings, quotes & payments
- Quote requests and bookings are made through the Service and subject to vendor acceptance.
- Payments are processed by third-party processors (such as Stripe). Partyfiy may hold funds and release payouts to vendors according to its published payout schedule.
- A platform commission may apply to completed bookings and is disclosed before confirmation.
- Prices are listed in Canadian dollars (CAD) unless stated otherwise.
4. Vendor obligations
Vendors must accurately represent their business, hold any required licences or permits, deliver services with reasonable skill and care, honour confirmed bookings, and comply with all applicable laws. Partyfiy may verify, feature, suspend, or remove vendor profiles and may take accountability action for cancellations, no-shows, or policy violations.
5. Disputes
We encourage parties to resolve issues directly. Where that is not possible, Partyfiy offers a dispute process. Partyfiy may, at its discretion, facilitate communication, mediate, withhold or reverse payouts, or take action against a party found to be in breach. Decisions are made in good faith but are not binding legal judgments.
6. Acceptable use
You agree to comply with our Acceptable Use Policy and not to misuse the Service, infringe others’ rights, post false or misleading content, attempt to bypass fees, or contact parties outside the platform to evade our protections.
7. Content & licences
You retain ownership of content you submit but grant Partyfiy a worldwide, royalty-free licence to host, display, and use it to operate and promote the Service. You represent that you have the rights to any content you upload. We may remove content that violates these Terms or applicable law.
8. Fees & subscriptions
Vendors may subscribe to paid plans; those terms are set out in our Subscription Agreement. We may change our fees with reasonable notice. Taxes, where applicable, are added to charges.
9. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Partyfiy disclaims all warranties and is not liable for the conduct or performance of vendors, the outcome of any booking, or indirect, incidental, or consequential damages. Our liability is limited to the extent permitted by applicable law.
10. Indemnification
You agree to indemnify and hold harmless Partyfiy from claims, damages, and expenses arising from your use of the Service, your content, or your breach of these Terms.
11. Termination
You may close your account at any time. We may suspend or terminate access if you violate these Terms or for any lawful reason, with or without notice. Provisions that by their nature should survive termination will remain in effect.
12. Changes & governing law
We may update these Terms and will note the revised date above. Continued use after changes constitutes acceptance. These Terms are governed by the laws of British Columbia and the federal laws of Canada, and you submit to the non-exclusive jurisdiction of the courts of British Columbia.
